Agreement

This document forms the Terms and Conditions and Warranty between the customer and Taylor Family Australia Pty Ltd T/AS Swiftco Trailers North Queensland, ABN 50 646 224 044. Whereas the term ‘You’ and “Your” is used throughout this document, refers to any customer, business, corporation or potential customer of Swiftco Trailers Townsville. Whereas “Swiftco” is used throughout this document refers to any division of Taylor Family Australia Pty Ltd T/AS Swiftco Trailers North Queensland, unless otherwise clearly stated within this document.

Customer Acknowledgement:

Customer acknowledges that by entering into a purchase with Swiftco, the full amount on the Swiftco invoice is due and payable, including GST and shipping and customer agrees to the item product/items listed on the invoice. Until full payment is received the product/items remains under full ownership of Swiftco. Swiftco is NOT liable for any loss or damage, injury or theft caused to your products, property or suffered by you or any third party in connection to products supplied by Swiftco or by, or during any delivery. Delivery of goods and timelines of delivery is at the risk of the customer Customers acknowledge they have 7 days from collecting item or item being delivered to check contents and goods match against their paid invoice. Prices are subject to change without notice. All prices are subject to 10% GST. Swiftco may cancel your order for certain reasons or may reject your order for any reason. You will be notified of this cancellation. For any outstanding invoices, a $25 (+GST) per month admin fee is charged.

Deposits

A minimum 10% deposit is required on acceptance of all Swiftco Trailer orders. Once a deposit has been paid by customer, but customer wishes to cancel, the customer forfeits 100% of the deposit amount if Swiftco have commenced production/shipped such product/item. If Swiftco have not commenced full production you may be applicable to up to 100% refund, depending on cycle of production. If customer is using a BNPL or finance product to purchase trailer, a 30% deposit is required on application. If approval is not granted via third party finance company, a full refund of deposit will occur. However if production has begun on the order, a refund cannot be granted.

Custom Orders
A minimum 30% deposit may be required on some custom orders. Once design finalised/materials purchased, customer forfeits deposit for change of mind/cancellation of order.

Collection of Goods

All trailers are to be picked up within 5 working days of being complete as we do not have a storage facility onsite. A $50 per day storage fee after this time may be applicable

Payments

The full balance on invoice, and any add on items/products/shipping must be paid in full with clear funds received and receipted by Swiftco before collection or shipping of product. A credit card fee (as charged by banks) as stated on invoice is applicable on all payments made by credit card. This fee will be added to the total amount payable or balance due and payable by you.

Payment methods

Direct Deposit- Check invoice for banking details.

Credit Cards- Visa and MasterCard only.- Surcharge applicable

Quotes

All quotes are valid for 14 days unless otherwise stated. If this time has passed, give us a call to reactivate an updated quote.

Debt Collection Fees

Any expenses incurred by Swiftco in the pursuit of reclaiming monies owed, including external fees such as, but not limited to, solicitors, debt collection agencies, QCAT, filing fee, bailiff fees shall be billed and paid by the customer to Swiftco on top of the invoiced amount owing. Interest and administration fees may also be added to the outstanding amount after 14 days of amount originally due by customer to Swiftco. Unpaid invoices will attract a $25 (+GST) fee per month. Swiftco may at its discretion withhold further supply of goods/suspend provision of credit whereby invoices have fallen behind by more than 30 days.

Freight, Shipping, Postage, Delivery by Third Party & External Operators

As Swiftco is not a freight company. Swiftco is not liable for any loss, theft or damage to any goods or product once in transit. Delivery of goods is at the risk of the customer.

Ownership

Once goods or products are placed in hands of Third Party Freight/delivery/courier companies, the ownership of product is transferred to the customer. Swiftco are not liable for loss, damage or any liability whatsoever once the product or goods leave the premises. This includes any products purchased via finance or payment companies whereby full funds are still forthcoming.

Production times

Certain peak periods and similar unforeseen events by our suppliers of components may see delivery delays experienced by Swiftco. If this is the case you will be notified immediately. During these unusual events, wait time for production/manufacture of items/products may extend up to 8-12 weeks.

Return / Refund Policy

Refunds are only applicable under written consent by Director of Swiftco. Goods must be returned in original condition and unused. If product/items has been used, products will be deemed as second hand and will not be eligible for a refund. Under acceptance of Director of Swiftco only, a refund may be approved with a cleaning fee of $99 per hour charged to customer. Any return costs for change of mind/incorrect product selected by customer is at the cost of the customer.

Due to special orders/custom orders being manufactured to order or your specific requirement, these items cannot be returned. Please double check measurements on your invoice / order requirements.

Warranty

Warranty is as per manufacturer’s terms and conditions. Warranty claims, must always be returned to place of purchase. All warranty periods are valid from date of customer order. This is usually constituted by full payment or deposit or written confirmation of job to proceed by customer. Warranty covers our customers against defective materials or workmanship.

Warranty does not cover freight/postage or costs involved in returning goods to store nor back to customer.

Trailers are a vehicle which require regular maintenance, like any vehicle this includes regular (minimum 6-month) servicing, 3 month servicing for commercial use. Swiftco can complete full servicing onsite.

Trailer customers are supplied with a digital copy and printed copy of the Swiftco Trailer Maintenance Manual, (can also be downloaded from our download section of our website) and MUST follow this and each step to avoid voiding warranty. This includes but not limited to, Steps To Boat Trailer Fitting, 50km Check, Servicing, General Trailer Maintenance, Washing Trailer Ezilube Grease System, Wheel Bearing Maintenance, Bearing Numbers. Any modifications made to a Swiftco Trailer voids the warranty unless supplied in writing by the Director of Swiftco.

Swiftco warranty does not cover misuse or products that have not been serviced/maintained, abused, used in a manner that product is not intended, stored ineffectively, been in an accident, fire or flood or normal wear and tear or hitting potholes or taken off-road if trailer not designed to be taken off-road. Lights are warranted on use and does not include broken/cracked lens, blown bulbs, lights that have been miss-used, removed or tampered with.

Hot Dipped Galvanised trailers

Swiftco galvanised trailers are warranted for 5 years (2years if purchased pre 1st July 2021). Such warranty is on the hot dipped galvanised frame and lights. All other components are warranted as per manufacturers warranty period and terms.

Aluminium Trailers

Swiftco Aluminium trailers are warranted for 6 years. Such warranty is on the aluminium frame and 5 years warranty on lights. All other components are warranted as per manufacturers warranty period and terms.

Swiftco warranty is for the first registered owner only. Warranty is not transferable.

Display / Demonstration Model

Display models are sold in an “as is, where is” condition and come with a limited warranty or as provided in writing by director of Swiftco. If no warranty certificate provided with display/demonstration items, then no Swiftco warranty is provided.

Storage of Customers Possessions

The customer acknowledges that any boat, trailer, equipment, work goods, tools, materials left on the property are the responsibility of the customer and Swiftco is not liable for any loss incurred.

Liability

Swiftco accepts no liability if something goes wrong while using one of our goods or products. Swiftco accepts no responsibility for loss of/damage to business or personal/public/product/item injury.

Sponsorship

Any prizes donated or provided under sponsorship must be collected within 5 days, unless previously arranged in writing by Director of Swiftco. Any gift vouchers must be used by their expiry date. No refund provided on Gift Vouchers for voucher amount if full voucher amount not used.
